1. Agreement to Terms

By accessing and using the jeanlucbenazetphotography.co.uk website and booking our services, you agree to be bound by these Terms of Service. If you do not agree to abide by any of the terms set forth below, please do not use this Service.

2. Booking and Contract

Enquiry and Consultation

When you enquire about our wedding photography services, we will discuss:

• Your wedding date and venue
• Your photography requirements
• Available packages and pricing
• Your vision and expectations

An enquiry does not constitute a booking. A booking is only confirmed when:

• You have received a written quote/proposal from us
• You have accepted the quote in writing (email confirmation)
• You have paid the deposit as specified in the proposal

Deposit and Payment

• A non-refundable deposit of 50% is required to secure your wedding date
• The remaining balance is due 14 days before your wedding date
• Payment can be made by bank transfer, card, or cheque
• Late payment may result in cancellation of the booking

Payment details and methods will be confirmed in writing.

3. Cancellation and Refunds

Cancellation by Client

More than 90 days before wedding:

• Deposit is refunded minus 10% administrative fee
• Balance is fully refunded if payment has been made

Between 90 and 30 days before wedding:

• Deposit is non-refundable
• Balance is refunded minus 25% cancellation fee

Less than 30 days before wedding:

• Deposit and balance are both non-refundable
• Full payment may be forfeited

Postponement:

If your wedding is postponed to another date within 12 months, your deposit will be carried forward. Rescheduling may incur additional charges if the new date falls on a premium date.

Cancellation by Photographer

We will only cancel in exceptional circumstances (illness, emergency, or force majeure). In such cases:

• You will be notified as soon as possible
• A full refund will be issued, or an alternative qualified photographer will be provided
• We accept no liability for any costs incurred as a result of our cancellation

4. Services Provided

Photography Coverage

Our service includes:

• Agreed number of hours of photography coverage as per your package
• Professional photography during the wedding ceremony and reception
• Posed group photographs
• Candid coverage of key moments
• Professional editing and colour correction of all images
• Delivery of high-resolution digital images

What is NOT Included

Unless specifically agreed in your proposal, the service does not include:

• Videography (unless purchased as an add-on)
• Printed albums or prints (can be ordered separately)
• Additional photographers or videographers beyond what is specified
• Coverage outside the agreed time period
• Drone photography (unless specified in your package)

5. Photographer's Responsibilities

We commit to:

• Arrive on time, prepared, and with backup equipment
• Conduct ourselves professionally and discreetly
• Capture all key moments as agreed
• Treat your wedding with the utmost care and importance
• Deliver edited images within the agreed timeframe (typically 4-6 weeks)
• Maintain professional standards of photography and conduct

6. Your Responsibilities

To ensure the best results, you agree to:

• Provide clear instructions regarding key family members, shots, and timings
• Ensure venue access is available (liaising with venue staff)
• Inform us of any photography restrictions at your venue
• Provide a detailed schedule and timeline for the day
• Not restrict our reasonable access to guests or locations
• Alert us to any changes to your schedule in advance

7. Image Ownership and Rights

Your Rights

Once you have paid in full, you own the copyright to all final edited images. You may:

• Print, display, and share the images for personal use
• Post images on social media
• Display images in your home
• Create albums, prints, and other memorabilia

Our Rights

You grant Jean-Luc Benazet Photography the right to:

• Use images for our portfolio and website
• Use images for marketing and promotional purposes
• Display images in exhibitions or publications
• Share images on social media and our website

Opt-Out Clause:

If you prefer your images not to be used for portfolio or marketing purposes, you must inform us in writing at the time of booking or within 7 days of receiving your images.

8. Image Delivery and Formats

What You Receive

Your package includes:

• High-resolution digital images (minimum 300dpi suitable for printing)
• A digital gallery (online access to download images)
• Professional editing and colour correction

Timeline

Images will typically be delivered within 4-6 weeks of your wedding date. We will inform you of any delays.

Digital Storage

We retain backup copies of your images for archival purposes for a minimum of 5 years. After this period, we may delete backups, so we recommend you maintain your own copies.

9. Limitations and Exclusions

Weather and Conditions

We will do our best to work with all weather conditions. However:

• Extreme weather may limit photography options
• We reserve the right to advise on alternative locations or timings if safety is compromised
• We cannot be held liable for poor lighting or weather conditions

Technical Issues

• We use professional-grade equipment with backup systems
• In the unlikely event of equipment failure, we will do our best to continue with backup equipment
• We are not liable for lost images due to technical failure if reasonable precautions have been taken

Force Majeure

We are not liable for failure to provide services due to circumstances beyond our reasonable control, including (but not limited to):

• Natural disasters
• Severe illness or injury
• Family emergency
• Other unforeseeable events

10. Dispute Resolution

If you are unhappy with our services:

• Please contact us within 7 days of receiving your images
• We will discuss your concerns and attempt to resolve them
• If images require editing adjustments, we will make reasonable amendments
• If we cannot reach a satisfactory resolution, either party may pursue legal remedies

11. Liability and Indemnity

Our Liability

Our liability is limited to the amount you have paid for our services. We are not liable for:

• Indirect or consequential losses
• Loss of profits or data
• Emotional distress or inconvenience
• Costs incurred as a result of poor weather, venue issues, or guest behaviour

Your Indemnity

You agree to indemnify and hold harmless Jean-Luc Benazet Photography from any claims, damages, or costs arising from:

• Your breach of these Terms
• Misuse of images you have received
• Claims by third parties regarding image ownership or use
• Breach of venue photography policies

12. Guest Photography Rights

By hiring Jean-Luc Benazet Photography, you confirm that:

• You have the right to authorise photography at your venue
• You have obtained any necessary permissions from the venue
• Guests attending will be informed that professional photography is taking place
• Guests consent to being photographed as part of the wedding coverage

13. Confidentiality

We treat all client information as confidential and will not disclose details of your wedding or images without your consent, except:

• Where required by law
• For the purposes stated in our Privacy Policy
• With your explicit permission

14. Insurance and Liability

Jean-Luc Benazet Photography carries professional indemnity insurance. This covers our professional services but does not cover circumstances beyond our control, as outlined in Section 9 above.

15. Intellectual Property

All materials on our website, including text, graphics, logos, and original artwork, are the property of Jean-Luc Benazet Photography or are used with permission. You may not reproduce, distribute, or transmit these materials without our express written consent.

16. Changes to Terms

We may update these Terms of Service from time to time. Any changes will be posted on this page with an updated "Last updated" date. Continued use of our services constitutes acceptance of updated terms.

For bookings made before any changes, the terms in place at the time of booking will apply unless you explicitly agree to new terms.
